Abstract
This article discusses about the development of Islamic law in the two periods: the companions of prophet an the tabi’in. The development of Islamic law in the Sahabah period placed since the death of the Prophet Muhammad SAW. At this time, the goverment led by the four caliphs; Abu Bakr al-Siddiq, Umar ibn al-Khattab, Uthman ibn Affan and Ali ibn Abi Talib. After their periods, then replaced by tabi’in period. Tabi’in period began from the Umayya to the Abbasid Caliphate. At this time began to develop schools of fiqh, such as: Hanafi, Maliki, Shafi’i, and Hanbali. In doing ijtihad they referred to the al-Qur’an, al-Sunnah, ijma’, and qiyas. In addition, there were some scholars who used the arguments istihsan, sad al-zari’ah, ‘urf, masalahat, and others.
