Dinamisasi Fiqh Muamalah menuju konsep perbankan syariah

This paper discusses the dynamics of discourse of fiqh mu'amalah towards to concept of shatrah banking. The existence of shari'ah banks needs to be critisized from the views of whether the concept used is socially beneficial; whether it is suitable with the intended goals or even contradictive. For example, is the concept of deviding gains and risks compliant or consistent with the intention of achieving social justice or not. To make it perfect, furthermore, shari'ah banks should be open to receiving any input which will develop the shari'ah banks. In this case, the sharrah-based banks can learn from capitalism which is always responsive to any criticisms. In that way, shari'ah-based banks may become par excellence in line with the advancement of modem era.
